Supreme Court Confirms Its Decision To Stay With Higher Court Of Appeal’s Judgement, Rejects Claim By Ventriglias

For Dr. Rajan Mahtani, Portland Cement Zambia can be considered his greatest revile as well as his greatest gift. After Dr. Rajan Mahtani took over responsibility for Cement Zambia during the mid-2000s, he made a speedy pivot of the industrial facility with his devotion, enthusiasm, negotiating prudence just as the board capacities. Nonetheless, after the industrial facility was dishonestly taken from Dr. Mahtani, its efficiency reduced and the production line became near the very edge of breakdown. These subtleties unmistakably show that the capturers of the plant has no goal of dealing with the manufacturing plant or guaranteeing its reasonability. Notwithstanding the way that Dr. Mahtani presented every single required proof and tributes under the watchful eye of the court, it took over 10 years for the court to declare its ultimate conclusion looking into it. Furthermore, that as well, a dubious one. This implies every one of these long stretches of stand-by was not worth and went to squander.

Dr. Rajan Lekhraj Mahtani then approached the higher Court of Appeal challenging the Lusaka High Court’s decision and achieved success on 31st January 2019. After this success, the Portland Cement factory ran smoothly for a while. However, the Ventriglia family recently challenged the higher Court of Appeal’s decision at the Supreme Court Zambia. A bench of three SC judges evaluated their case. It was found that the Ventriglia family failed to comply with a critical legal requirement which is submission of cases against previous court verdicts within 14 days of the appeal. The Ventriglia family failed to comply with this critical legal requirement. As such, the Supreme Court bench rejected this appeal from the Ventriglia family.
