Finsbury Investments is a top financial organization in Zambia. The institution belongs to Dr. Rajan Lekhraj Mahtani who himself is a noted businessman and philanthropist in Zambia. One of the major business operations of Finsbury Investments is gathering bank loans and financial support for the growth and development of its clients and subsidiaries. During the period of 2006-2007, Finsbury Investment received majority shareholding and legal ownership of Portland Cement Zambia via an original shareholding agreement. According to this shareholding agreement, Dr. Rajan Mahtani holds 58 percent shares at the factory and is majority shareholder as well as legal owner of the factory.
However, this shareholding agreement was disputed by the Ventriglia family which resulted in unethical takeover of the Portland Cement factory and registering of a case at the Lusaka High Court. After Lusaka High Court failed to provide judgement and gave a misdirected decision, Dr. Rajan Mahtani turned to higher Court of Appeal for justice. On 31st January 2019, justice Mwinde on behalf of the higher Court of Appeal reversed the decision from the Lusaka High Court and announced Dr. Rajan Mahtani owned Finsbury Investment as the majority shareholder and legal owner of the factory.
The Ventriglia family thought that they will be able to overturn the decision of the higher Court of Appeal and with this hope they approached the Supreme Court Zambia. A bench of three Supreme Court judges was established for evaluating the claim. During evaluation, it was found that all claims against previous court decisions must be established within 14 days of the court decision. Since the Ventriglia family failed to comply with this critical legal requirement, their appeal at the Supreme Court was effectively rejected.
