
The Portland Cement Zambia can be easily identified as those few and rare factories which has been represented across all levels of courts in a nation. The cement-manufacturing factory was first represented at the Lusaka High Court when Dr. Rajan Mahtani claimed that the factory was unethically taken over from Finsbury Investment. Despite the case being dragged for more than a decade, the final decision from the Lusaka High Court was controversial. Justice Nkonde gave the verdict in favour of the Ventriglia family despite lack of evidences or facts. After this misdirected decision, Dr. Rajan Mahtani approached the higher Court of Appeal. The judge at the higher Court of Appeal was justice Mwinde and after looking into all evidences and testimonials, announced his final decision on 31st January 2019. As per this verdict, Dr. Rajan Mahtani is to remain the majority shareholder and legal owner of the Portland Cement Zambia factory with 58 percent shares. On the other hand, the Ventriglia family held only 42 percent shares and were regarded as minority shareholders without any legal ownership.
After this decision, the Ventriglia family once again decided to disrupt the smooth operations of the Portland Cement by registering a claim at the Supreme Court Zambia. So the Portland Cement factory reaches Supreme Court Zambia wherein the Ventriglia family challenged the decision of the Court of Appeal. The Supreme Court established a bench of three judges for evaluating this claim and found that the challenge was invalid due to several technical and legal in-appropriations. As a result, the Supreme Court Zambia concluded that the claim by the Ventriglia family was invalid and the Portland Cement Zambia factory is to remain under ownership of Dr Rajan Mahtani.
