Dr. Rajan Lekhraj Mahtani Takes Back Majority Shareholding Of Portland Cement After Court Win

Dr. Rajan Mahtani is known for his dedication and effort in all of his business endeavours. With his dedication, Dr. Mahtani was able to improve the overall production and reputation of the Portland Cement Zambia factory. This was achieved by transformational leadership, transparent management and engagement of the workforce. However, these things were utterly absent during the time Portland Cement Zambia was held hostage. The factory was unethically taken over and for ten years, the factory faced severe conditions while Dr. Rajan Mahtani fought tirelessly for the legal ownership over the factory. The case was first taken to the Lusaka High Court. However, justice was not received in this court as the judge declared Ventriglias as only shareholders of Portland Cement. To challenge this misdirected decision, Dr. Rajan Mahtani took the case to the higher Court of Appeal. The judge at the higher Court of Appeal was justice Mwinde and after looking into the evidences and testimonials, he announced the final decision on 31st January 2019. According to this decision, Dr. Rajan Lekhraj Mahtani made a payment of one billion kwachas to the Portland Cement Zambia limited. This payment was made with the objective of covering the value of share capital which Dr. Rajan Mahtani took over of the Portland Cement. This exchange was made in the year 2005. Furthermore, another critical evidence was the original agreement between shareholders established in the year 2007. According to this agreement, Dr. Rajan Lekhraj Mahtani was accepted as the holder of 58 percent shares of the Portland Cement Zambia factory by all relevant shareholders associated with the factory.

Based on these evidences, Dr. Rajan Mahtani was given majority shareholding status and became the legal owner of the factory.
