For Dr. Rajan Lekhraj Mahtani, the path for reacquiring Portland Cement Zambia factory was filled with challenges and difficulties. While Dr. Rajan Mahtani did achieve success and justice at the end, very few businessmen would dare to follow a path of transparency, ethics and honesty in a nation where corruption and unethical practices are more common and accepted. Dr. Rajan Mahtani’s struggle started more than a decade ago after registering the case at the Lusaka High Court. Along with the case, Dr. Mahtani submitted almost all evidences which proved his legal ownership over the factory. While these evidences clearly indicated that Dr. Mahtani was actual owner of the factory, the Lusaka High Court justice gave a judgement which was otherwise. After more than ten years of case proceedings and getting nowhere, justice Nkonde from the Lusaka High Court announced that Ventriglias were only shareholders of the Portland Cement Zambia.
While Dr. Rajan Mahtani was surely disappointed by this controversial judgment, he did not lose hope and again registered at the higher Court of Appeal. The judge at the higher Court of Appeal was justice Mwinde who gave a much quicker and appropriate judgement. This decision was given on 31st January 2019 based on all evidences and testimonials. For instance, the evidences clearly confirmed that Dr. Rajan Mahtani paid USD 250,000 or one billion kwachas to the Zambezi Portland Cement limited. This amount covered the entire value of the share capital which Dr. Mahtani owed to the cement factory. The details of these transaction were also provided in the stakeholders agreement established in the year 2007.
Based on all these evidences, Dr. Rajan Lekhraj Mahtani was announced as majority shareholder and legal owner of the factory.
