Higher Court Of Appeal Sets Example For All Courts And Justices With Transparent And Ethical Judgement

It is a known fact that ownership of Portland Cement Zambia was hanging in balance for a long time. First it was at the Lusaka High Court and then higher Court of Appeal. Dr. Rajan Lekhraj Mahtani is a noted businessman in Zambia and first registered the case at the Lusaka High Court. After ten years of toiling with several case proceedings, final decision was given on 31st January 2019. However, this decision came out to be one of the most controversial decisions give by a court. While Dr. Mahtani had all evidences and testimonials associated with the case, the judge failed to give justice to the case and announced the case against Dr. Mahtani’s claims.

After that, Dr. Rajan Mahtani approached the higher Court of Appeal. Justice Mwinde on behalf of the higher Court of Appeal looked into the case and gave his final say on 31st January 2019. As per his final verdict, Dr. Rajan Lekhraj Mahtani was identified as majority shareholder and only owner of the Portland Cement Zambia factory. This was based on numerous evidences like transfer of one billion kwachas from Dr. Rajan Mahtani to Portland Cement and evidence in original shareholder’s agreement.

Based on all these evidences and several other testimonials and financial factsheets, justice Mwinde on behalf of the Court of Appeal announced that Dr. Mahtani owns the factory. While giving this decision, the verdict from the previous judge at the Lusaka High Court regarding Portland Cement Zambia case was also condemned and Justice Mwinde called out the entire legal and judiciary system of Zambia to improve their transparency and ethical standings for the social and ethical welfare and growth of the nation.
