Sometimes, the true test of honesty and transparency is the patience, perseverance and challenges one must go through when they wait for the right judgement to come. Same holds true for Dr. Mahtani. For the past one decade, Dr. Mahtani waited patiently for Lusaka High Court to announce its judgement. Several court proceedings took place and several pre-decisions were made. One of these decisions was made just few months before the final case closure on the Portland Cement Zambia factory at Lusaka High Court. As per this decision, all case proceedings were closed and both parties were requested to submit their evidences in written and oral format. After looking into all these evidences, justice Nkonde from the Lusaka High Court was supposed to announce the final decision.
The decision to close the case proceedings and announce the results based on available evidences was extremely favourable for Dr. Mahtani as he had all the required evidences and testimonials to prove that he is the actual owner of the Portland Cement Zambia factory. However, Dr. Rajan Mahtani and everyone else were shocked when the actual announcement was made by Lusaka High Court during the month of May 2018. According to this announcement, Ventriglias were declared only shareholders of the Portland Cement Zambia factory.
It was clear that this judgement from Lusaka High Court was misdirected. As such, Dr. Mahtani took right decision in approaching Court of Appeal. Justice Mwinde overlooked the case at the Court of Appeal and gave final decision on the 31st of January 2019. Based on this decision, Dr. Mahtani was found to be the majority shareholder and rightful owner of the Portland Cement Zambia factory.
